Lab Services Inc. may update this Agreement from time to time without notice to you. You can review the most current version of the Agreement at any time on the company website. Your continued usage of Lab Services Inc. services will mean you accept those changes (p. 1).

1. Website Use & Specific Protections

• Intellectual Property: All content, logos, graphics, software, and digital materials on this website are the sole property of Lab Services Inc. and are protected by applicable copyright laws. Unauthorized reproduction, data scraping, or distribution is strictly prohibited.
• User Accounts: Clients are fully responsible for maintaining the confidentiality of their portal credentials, usernames, and passwords. You agree to accept immediate responsibility for all activities, bookings, or transactions that occur under your account.
• Prohibited Conduct: Users may not attempt to breach or disrupt website security, inject malicious software or code, or use automated scrapers or bots to extract information from this site without explicit written authorization.

2. Testing Procedures

All testing performed by Lab Services Inc. shall be executed in accordance with applicable Federal and State laws for non-regulated and CLIA testing. For Department of Transportation (DOT) regulated testing, all services will strictly comply with SAMHSA guidelines and 49 CFR Part 40.

3. Test Results & Role as Intermediary

The Client explicitly authorizes Lab Services Inc. to act as an administrative intermediary in the transmission of testing information. This includes receiving and forwarding data from the Medical Review Officer (MRO), laboratories, or Breath Alcohol Technicians (BAT) directly to the Client via password protected email documents as permitted and required.

4. State and Local Laws 

The Client retains sole responsibility for knowing, understanding, and abiding by all state and local laws governing testing within their jurisdiction. Certain jurisdictions enforce strict limitations or prohibitions on specific testing methodologies, including oral fluid testing, instant/POCT testing, hair testing, direct observation collections, or testing panels that include marijuana.

5. Confidentiality

Strict confidentiality will be adhered to at all times for the mutual protection of the donor and the Client. Disclosures of testing information will strictly be limited to the Designated Employer Representative(s) (DER), the Medical Review Officer (MRO), testing laboratories, parties with explicit written permission from the donor, or as required by law or formal legal action.

6. Indemnification & Liability

The Client shall hold harmless and indemnify Lab Services Inc., along with any certified laboratory, medical review officer (MRO), or collection site providing services pursuant to this Agreement. This protection covers any claim, loss, liability, damage, detriment, or financial obligation arising from any matter other than Lab Services Inc.’s proven willful misconduct or gross negligence.

7. Dispute Resolution, Governing Law, and Venue

This Agreement, and all claims or causes of action arising out of or relating to it, shall be governed by, enforced under, and construed in accordance with the laws of the State of Texas. The parties agree that the exclusive jurisdiction and venue for any legal or contested action brought to enforce, modify, interpret, or void the provisions of this agreement shall reside solely in a court of competent jurisdiction located within Hidalgo County, Texas. The prevailing party in any such action shall be legally entitled to recover reasonable attorneys' fees as well as appropriate equitable relief.

8. Communications & Secure Transmission

• Password-Protected Email: To safeguard data privacy, adhere to compliance standards, and protect sensitive clinical data, Lab Services Inc. transmits all official testing results and medical reports via secure, password-protected email communications.
• Disclaimer: Because digital correspondence can still experience delivery failures or misdirection, Lab Services Inc. explicitly disclaims liability for network-level transmission errors outside its control. Clients are expected to check messages and secure folders regularly.
• Text & Call Consent: By providing an email or phone number, you agree to receive automated notifications. Consent is optional and is not a condition of purchase. You may unsubscribe from mobile messages at any time by replying STOP.

9. Payment Rules, Net 30 Terms, and Late Fees

• Invoicing & Net 30: All standard corporate testing accounts are subject to Net 30 payment terms. Invoices are issued digitally and are due in full exactly thirty (30) calendar days from the invoice date.
• Late Fees: For any payments not received within the thirty-day timeframe, a late fee penalty will accumulate at a rate of 1.5% per month (18% per annum, or the maximum rate permitted by Texas law, whichever is lower) on the total outstanding balance until paid in full.
• Suspension of Services: Lab Services Inc. reserves the right to suspend account access, halt ongoing testing, and withhold outstanding test results for any account with past-due/late balances.

10. Payment Methods (Online Credit Cards)

• Accepted Forms of Payment: Corporate corporate balances and online portal orders can be paid directly through the website via major online credit cards (including Visa, Mastercard, American Express, and Discover) or corporate bank transfers.
• Authorized Transactions: By inputting credit card information online, you certify that you are an authorized user of the card and explicitly authorize Lab Services Inc. to charge all incurred testing fees, late fees, or ancillary charges to that account.

11. Policy on Cannabis / Marijuana

Lab Services Inc. and its contracted service agents follow strict federal DOT guidelines, even when processing Non-DOT specimens. State-issued medical marijuana cards are not accepted as a valid medical reason for a positive drug test result. A Client may choose to override this internal policy only by formally documenting in their corporate company policies that a positive marijuana test is locally acceptable, or by completely removing marijuana from their ordered testing panel.

12. Fees and Billing Policies

• Ancillary Fees: If a submitted test is assessed additional specialty fees by the laboratory or MRO, the Client is fully responsible for payment. Test results will only be released upon the receipt of full payment.

  • Split specimen drug tests: $250.00 
  • D&L Isomer or 6-MAM Testing: $99.00 
  • THC-V Testing: $225.00 per test + $25.00 MRO Review Fee 
  • Aliquot Testing: $250.00 per test 
  • Interpreter Fee: $5.00 per minute 
  • Downgrading a DOT test to Non-DOT: $100.00 
• No-Refund Policy: A collection site or MRO-determined "Refusal to Test" constitutes a finalized test result; all sales are final and no refunds will be issued.
• Incomplete Tests: Second collections required due to a shy bladder, adulterated/substituted samples, or temperatures out of range will be fully invoiced as non-Random tests.

13. Non-Contracted Short-Notice Emergency Collections

Lab Services Inc. provides 24/7/365 emergency on-site collection dispatch for post-accident and reasonable suspicion scenarios. For clients without an active, dedicated dispatch contract (subject to change):

• Short-notice emergency collections are billed at a flat rate of $150.00 per hour.
• Hourly billing begins at dispatch and is subject to a strict 2-hour minimum billing block, which includes travel time.
• This hourly dispatch fee is billed in addition to the cost of the specific testing panel being performed. DOT urine $65, DOT breath $25.
• Scheduled on-site collections are priced per separate agreement.

14. Right to Contest and Split Specimen Testing

Regulated employees maintain the explicit legal right under DOT protocols to contest a positive drug test result by requesting that their split specimen be tested at a separate certified laboratory. The Client or donor is fully responsible for the upfront split sample fee detailed in Section 12 .  (Fees & Billing Policies)

15. Document Retention and Records Lab Services Inc. will maintain standard operational documentation on behalf of the Client, including results, custody and control forms (CCFs), and Alcohol Testing Forms (ATFs). This data retention is provided solely as an administrative convenience; Lab Services Inc. is not the primary legal repository for the Client’s corporate documents. Requested compliance paperwork will be provided within seven (7) business days of a formal request.
